Wages  FORMTEXT (3) performs a sample review of payrolls every  FORMTEXT (4) to ensure nondiscriminatory wage payments between minorities and nonminorities and between males and females in each respective job classification (see Exhibit 4). There was no documentation of the payroll reviews done by  FORMTEXT (3). A sample review of the company s payrolls revealed no disparities in the payment of wages.  b.  Working Conditions  FORMTEXT (3) makes periodic project site visits for the purpose of observing working conditions, to ensure a working environment free from harassment, intimidation, or coercion, and to ensure nondiscriminatory treatment of project site personnel.  FORMTEXT (3) keeps a record of these visits (See Exhibit 5). This was also verified through interviews with project site employees. There was no documentation available at the time of the review to indicate the contractors efforts to inspect the project site to ensure a working environment free from harassment, intimidation, or coercion and to ensure nondiscriminatory treatment of project site personnel.  c.  Benefits Nonunion: Contractor has a benefit program which provides  FORMTEXT (5). All employees may elect to be covered under the program after being employed for  FORMTEXT (6). Based on a sample review, it appears the company benefits are being provided on a nondiscriminatory basis. The Contractor has no benefits for employees. Union: Benefits are paid by the contractor to each employee in accordance with the applicable union agreement.  d. Nonunion: The company provided no documentation of its efforts to recruit and hire minority operators. Documentation was sufficient to indicate the contractors minority and female recruitment efforts in all job categories where new hires were made. Union: Unions appeared to provide a satisfactory number of minorities and females. Although contractors documented minority and female recruitment efforts through the unions were satisfactory, the union(s) failed to provide an adequate number of minorities and females. The contractor provided no documentation of the companys efforts to recruit minorities and females outside the unions for referral to the unions. The contractor recruited  FORMTEXT (8) minorities and  FORMTEXT (9) females and referred them to the union(s). Of these referrals the union(s) accepted  FORMTEXT (10).  f.  Training The contractor has  FORMTEXT (11) OJT slots on this project. One slot is filled with a  FORMTEXT (12) hired during the review period. This trainee is in his/her  FORMTEXT (13) phase of training. Based on an interview with the trainee and the trainees supervisor, it appears his/her training is progressing satisfactorily. The contractor is now in the process of filling the second slot with a  FORMTEXT (14) trainee.  FORMTEXT (3) stated that efforts to locate a female/minority trainee would begin in one week. The contractor has  FORMTEXT (15) OJT slots on the project. One is a  FORMTEXT (16) and one is a  FORMTEXT (17). Currently, there is still a low representation of minorities and/or women in the  FORMTEXT (18) category. The company provided no documentation of efforts made to recruit and hire a female/minority for the  FORMTEXT (19) trainee slot. The company provided sufficient documentation of efforts made to recruit and hire a female/minority for the  FORMTEXT (19) trainee slot. There were no OJT training slots assigned to this project. Also, there was no training completed on this project during the review period. There were no OJT training slots assigned to this project. However, the contractor did complete training during the review period. Interviews with the workers and review of selection methods show training appears to be done on a non-discriminatory basis.  g.  Demotions There was one demotion during the review period. The person demoted was a  FORMTEXT (20). A review of the circumstances surrounding the demotion indicate it was made without regard to race or gender, i.e. in a non-discriminatory manner. There were no demotions during the review period.  h.  Layoffs Layoffs during the review period consisted of  FORMTEXT (21). A review of the circumstances surrounding the layoffs indicate the layoffs were caused by completion of a project or a portion of a project. No disparities were found in the layoffs. There were no layoffs on this project during the review period.  I.  Terminations  FORMTEXT (22) and  FORMTEXT (23) were fired during the review period. The first was terminated for  FORMTEXT (24) and the second was terminated for  FORMTEXT (25). The terminations appear to have been made in a non-discriminatory manner. There were no terminations during the review period.  j.  Transfers Frequent employee transfers have occurred during the review period. Minorities and/or females have been included in the transfers. Based on an examination of company documentation and employee interviews, it appears that transfers were made on a nondiscriminatory basis. Several employee transfers have occurred during the review period. Minorities and females have not been included in the transfers. A review of company documentation and employee interviews indicates this lack of participation is not due to discriminatory treatment or minorities and females. No transfers occurred during the review period.  k.  Discrimination Complaints The contractor received one complaint during the review period. The complaint was filed by a  FORMTEXT (26) alleging  FORMTEXT (27) by  FORMTEXT (28)  FORMTEXT (29). The EEO Officer investigated the allegation by interviewing all relevant personnel. A resolution which is satisfactory to the complainant was reached internally. A subsequent meeting was held with all employees and supervisors to reaffirm the company EEO policy. The Nebraska Equal Opportunity Commission notified the contractor that a complaint had been filed by  FORMTEXT (30). The complaint alleged  FORMTEXT (31). The complaint is currently pending.
